Terms of Use

These terms apply to the Knowdelia website (knowdelia.com) and to all Knowdelia products, including the busca.click browser extension and Knowdelia apps (together, the “Products”). The Products are provided by KNOWDELIA S.R.L., a company registered in Romania with its registered office at Strada Regele Ferdinand 22-26, 3rd Floor, 400110 Cluj-Napoca, Romania, Trade Register no. J12/784/2023 (EUID ROONRC.J12/784/2023), tax ID (CUI) 47669576 (“Knowdelia”, “we”, “us”). By installing or using a Product, you agree to these terms.

1. Using the Products

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Products for personal or professional purposes, in line with these terms and the rules of the store you got them from.

You agree not to:

• use the Products in a way that breaks the law or the terms of the websites you use them on;
• copy, modify, resell or redistribute the Products, except as the law allows;
• reverse engineer the Products, except where the law allows it despite this restriction;
• interfere with the Products or use them to harm others.

2. Your content

What you save or create with the Products belongs to you. Our Products store it on your device, so you are responsible for keeping backups (for example, with the export feature where one is available). How we handle data is described in our Privacy Policy.

3. Price and changes

Unless a Product says otherwise, it is free. We may improve, change or discontinue Products or features. If we ever introduce paid features, we will show the price and terms clearly before you buy.

4. Intellectual property

The Products, the Knowdelia and busca.click names, logos and designs, and this website are owned by KNOWDELIA S.R.L. or its licensors. These terms do not give you any rights to them beyond the licence above.

5. Third-party websites and stores

The Products work with websites run by others. We are not responsible for those websites, their content or their terms. Information a Product shows you, such as prices, comes from those websites and may be incomplete or out of date.

6. Apps from the Apple App Store

If you got a Product from the Apple App Store, the following also applies:

• These terms are between you and KNOWDELIA S.R.L. only, not Apple. We, not Apple, are responsible for the app and its content.
• Your licence is limited to using the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
• If a third party claims that the app infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

7. Disclaimer

The Products are provided “as is” and “as available”. To the extent permitted by law, we make no warranties, express or implied, including that the Products will be error-free or uninterrupted. Nothing in these terms limits rights you have as a consumer that cannot be waived under the law that applies to you.

8. Limitation of liability

To the extent permitted by law, KNOWDELIA S.R.L. is not liable for indirect or consequential losses, or for loss of data, profits or business, arising from your use of the Products. Nothing in these terms excludes liability that cannot be excluded by law, such as liability for fraud, gross negligence or death or personal injury caused by negligence.

9. Ending these terms

You can stop using the Products at any time by uninstalling them. We may suspend or end your licence if you seriously break these terms. Sections 2, 4, 7, 8 and 10 continue after the licence ends.

10. Changes and governing law

We may update these terms. We will post the new version here with a new date, and for significant changes we will give notice in the Product or on knowdelia.com. These terms are governed by the laws of Romania, without prejudice to the mandatory consumer protection rules of the country where you live.
